Service Agreement

1.  At TECHCON, we are determined to provide the most suitable first-class products, services and total solutions to our valued customers. Our general policy is to act as a leading-edge I.T. solution provider.
2.  TECHCON reserves the right to suspend or cancel a customer’s access to any or all services provided by or even terminate all contracts signed by TECHCON without any responsibility and indemnity when TECHCON decides that the account or the client has been inappropriately used or infringed the rules set by TECHCON, the industry, and the governments.
3.  TECHCON will not be responsible for any damages your business may suffer. TECHCON makes no warranties of any kind products, services or solutions we provide. TECHCON disclaims any warranty or merchantability or fitness for a particular purpose.
4.  TECHCON provides our warranty support to our clients who have bought the technical support services within the specified period and specified company (If clients do not purchase additional company database setup & maintenance plan, TECHCON will provide technical support services to only one the specified company database). The support service does not include tracing data error, data input, on-site support, and tailor-made system design or solution change. If clients request the above services, they need to purchase them additionally. Supporting service is performed during the office hour only. Please refer to our office hour. (TECHCON reserves the rights to modify the working hour and supporting hour at any time or any circumstances without prior notification) For those customers who have purchased our TECHCON System must contact us to unregister the system license before changing new computer hardware; otherwise, the purchased license cannot be transferred, be used or be registered to any new computer hardware, the whole system license has to be purchased again. Unless specific mentioned, all hardware bought from TECHCON have 1-year support warranty period. Hardware Support Warranty does not include the problems caused by any abnormal use of the hardware products, the 2nd year purchased hardware warrant plan includes only the hardware checking and repairing labour charge, excluding any hardware parts change fee and any hardware delivery charge from and to TECHCON. For those clients who do not purchase system maintenance plan, TECHCON would provide certain free system registration and unregiatration services (excluding any system setup, configuration, or technical support services) in case by case manner decided by TECHCON.
5.  If the Web Site /E-Shop service plan is expired, TECHCON do not help the client to retain either the system setting data or the database. Please reminded to backup all needed system data before the service plan is over by the client herself.
6.  If TECHCON's on-site service cannot be continued, and it's caused by client's computer or related device problem, the client also has to pay minimum HK$800 (2 hour) as the on-site service fee. The hardware provided by TECHCON (e.g. routers, hubs, network cables) is only available for use by TECHCON systems. Due to different reasons in the actual installation location during installation (for example: the size of the installation site, the separation of materials such as pillars or metal, different floors, different location units, hardware or hardware setting has been changed by a third party, etc.) causing the signal to be unstable or not enough, client need to purchase additional hardware from TECHCON and repurchase hardware setup services.
7.  TECHCON allows our clients to confirm their finalized printout template design within 14 days after the invoice date. Once the printout template design was confirmed, it cannot be changed afterwards, the date of finalized printout template design follows the earlier occurring date. If clients request to change the printout template design, they have to purchase it additionally. Clients need to start all the contract items within 3 months against the signed contract date; otherwise, TECHCON has the right to request clients to pay all the contract amount. All the built-in features on the purchased system are not tailor-made to clients. If clients request any tailor-made feature, please contact to the related Sales Staff for additional Quotation.
8.  Graphic design and printout template design does not include any art, modification on photo color, brightness, clearness. We do not accept any feeling or abstract requirements. Each design page is measured in A4 size. (All designs must be confirmed and finalized within 14 days after the invoice date.) All design must follow the exisiting system features, no system feature can be changed.
9.  Clients have to pay all remaining balance within 7 days after signing the Quotation, the Invoice, or other contract documents. If clients start using the installed hardware and software (including part of the features) or signing the Delivery Note / Invoice (not accepting any handwriting change by clients on the printed documents), this means that clients agree and confirm the completion of the system installation / all tasks, clients need to pay the contract specified amount to TECHCON immediately. Clients cannot cancel the contract; otherwise, clients still need to pay all the contract balance. For late payment, TECHCON reserves the right to stop providing services to clients at any time, and clients need to pay the appropriate compensation and penalty interests (10%p.a. of the remaining balance) to TECHCON. TECHCON reserves all legal rights.
10.  TECHCON expects that all its clients who provide services to others will comply fully with all applicable laws. A client's failure to comply with those laws will violate TECHCON policy. If TECHCON is sued because of activities of the client that violate any law or the Services Agreement, the client will pay any damages awarded against TECHCON, plus any lost induced, costs and reasonable attorneys' fees.
11.  If clients send back the expired signed contract documents (e.g. Quotation or Invoice), the final validity of the contract is decided by TECHCON. All received money is non-refundable in any circumstances.
12.  TECHCON reserves the right to add our trademark, system name, company name, or hyperlink on our systems and printouts; Clients cannot delete or modify them. Hardware products based on the product delivery.
13.  TECHCON reserves the copyright to our systems, marketing leaflets, DVDs/CDs, covers, and training materials, clients or any third party cannot copy or modify them without our permission. TECHCON reserves all legal rights.
14.  TECHCON reserves all the rights on final explanation and decision of fees, charges, product features, solutions in relation to TECHCON’s products and services.
15.  TECHCON reserves the rights to modify the Polices and Terms & Conditions at any time or any circumstances without prior notification.
